This document sets out the data confidentiality policy applied by Landfiles.
In short, Landfiles protects your data and limits its use to the proper operation of the Application, with a view to providing services to Users.
You remain the owner of your data. Any additional service (e.g. a scientific study) requiring specific data processing will give rise to a request for explicit consent addressed to each user, via their user area. By default, and without any choice on the part of the user, the data is not used for these additional services.
This application (hereinafter referred to as the “Application”) is provided by Landfiles, a SASU with capital of 50,000 euros, registered with the Paris Trade and Companies Register under number 830139564, whose registered office is at 17 Rue Bérenger 75003 PARIS, represented by Mr Nicolas MINARY acting in his capacity as Chairman, (hereinafter referred to as “we” or “Landfiles”).
The confidentiality of your Personal Data is of paramount importance to Landfiles, which has implemented strict rules and procedures to protect it. You should read this Privacy Policy carefully.
You are fully informed that the personal data submitted and collected will be subject to automated processing, as described below.
The Data Confidentiality Policy may be waived when a farm registers for a group on the Application. In all cases, you will be informed of any derogation when a farm registers for a group, in the group’s legal notice, and such derogation will be subject to your prior acceptance. You may notify us at any time of your refusal of these derogation conditions via the contact procedure in this document. We will not derogate from this Privacy Policy in the absence of your specific agreement.
- Personal data
1.1 Collection and processing of personal data
In order to provide the Application, we need to collect the personal data necessary for its functionality.
This Data Privacy Policy informs you of the manner in which Landfiles collects and processes your personal data when you use the Application.
Use of the Application requires the collection of the following data, which must be provided when creating your user account:
- Last name, first name
- Email address
- Phone number
- Password
- Your profession*
- Your working group (CETA, GIEE, etc.) or membership structure (your employer, your company, your educational structure, etc.)
- mandatory data.
This personal data may also be updated on your user account throughout your use of the Application, as soon as the functionality becomes available. In the meantime, you can contact Landfiles to modify this data at the following address: support@landfiles.com
When you use our Application, the following data may be transmitted to us by the Application, in order to enable its operation or optimisation:
- Your GPS coordinates when a photograph is taken
- The date and time of access.
Your surname, first name and profession will be communicated to other users of the application to enable the creation of a community and the sharing of information, which you accept.
The other information will not be provided to any other third party without your consent, with the exception of our sub-contractors and in accordance with this Data Confidentiality Policy.
The personal data collected is stored within the European Union, by a service provider that applies industry standards in terms of IT security.
This personal data will be kept for two (2) years, or for as long as the user account is active. Upon deletion of your user account, for whatever reason, we will delete all your personal data, with the exception of that which is strictly necessary to maintain our commercial accounts and to comply with our legal obligations.
1.2 Your rights
In accordance with the French Data Protection Act (Loi Informatique et Libertés) and the RGPD, you have the following rights with regard to any personal data transmitted to Landfiles:
- Right of access and information about your personal data stored by us;
- Right to request correction, deletion or restricted processing of your personal data;
- Right to object to processing on grounds of legitimate interest, public interest or profiling, unless we can demonstrate compelling legitimate grounds overriding your interests, rights and freedoms, or that such processing is carried out for the purposes of asserting, exercising or defending legal claims;
- Right to data portability ;
- Right to lodge a complaint with a data protection authority ;
- Right to revoke your consent to the collection, processing and future use of your personal data.

In accordance with its legal obligations, Landfiles will comply within a maximum of one (1) month from receipt of the request.
- Other data not constituting personal data
2.1 Personal data
In the course of using the Application, other data (photographs and descriptions, comments and tags, list of plots and animals, information about the farm), which do not constitute personal data, will be transmitted to Landfiles.
We can thus access, with your agreement in the Application, the following elements:

Your other personal data is used to implement search functions and to put users of the Application in touch with each other.
You are responsible for the content and accuracy of this data and information, and for respecting the rights of third parties to this data.
Nominative public data: the person who puts it online retains ownership, which he or she shares with the farm’s legal representative, who can therefore use the public data published by another user as he or she sees fit.
2.2 Anonymised data
Your other, anonymised, data is used to implement functions internal to the application, in particular to enable the search and matchmaking functions to operate.
Landfiles does not make any other use of anonymous data without the user’s consent. Anonymised data (whether public or private) may be used to create algorithms, statistics and studies, the purpose of which is set out in your user account, where you can give your consent to the use of the data. If you agree, this anonymised data will be used free of charge and for an unlimited period by Landfiles. By default, your anonymised data is not used for these purposes.
The process for anonymising data is as follows:
- -The author of the data publication is deleted.
- -The name of the farm linked to the publication is deleted, as are the national identifiers.
- -The location (except department) of the farm has been removed.
We can reconcile data from the same farm before it is anonymised:
- -Link between photos, tags, comments and observations before applying the anonymisation procedure. The link between elements therefore becomes a technical link and no longer a link via the author or the farm in question.
- -Link between the parcel or animal or group of animals, where the name of the parcel or animal or group of animals is replaced by a technical link that does not allow the source data to be traced.

4.1 Creating and administering a group in Landfiles
You can create a workgroup in Landfiles at any time, and automatically become its administrator. You can invite other people to join your group simply by sending an e-mail invitation, by forwarding the group link to your contacts or by sending an invitation directly via the application. To become a member, users must create a Landfiles account and accept the terms of use of the application as well as the data confidentiality policy contained herein. As administrator, you are responsible for ensuring that these conditions are respected within your group. Any member who joins the group will have access to all the information and publications in the group, including its history. If you wish to add operating rules to the group, you can indicate them in the group description.
You can choose to exclude from the group anyone who does not respect the Landfiles operating rules as well as your own rules, and the user can choose to unsubscribe from the group at any time.
Leaving the group, for whatever reason, prohibits you from accessing the user’s personal data, and you undertake not to use any information obtained about the user through the Landfiles application. Landfiles reserves the right to take any legal action in the event that the administrator does not respect the user’s rights in the event of unsubscription to the group, and to refer the matter to the CNIL.
4.2 Managing personal data as part of a group
There are 2 ways of joining a group in Landfiles:
- By invitation from a member of the group or the administrator
- By the user initiating a request to join this group
Participating in a group allows you to view comments, photos, publications and actions communicated by other users in the group; it also allows you to react to these publications by liking them, commenting on them or sharing them inside or outside the group. You can publish to these groups yourself under the same conditions, as a guest.
Joining a group automatically gives the administrator and group members access to the following personal information:
- Your full name, e-mail address
- The name of your farm
- The postcode and town of your farm
- Its geolocation if you have entered it
- All the information entered on your farm form:
- Observations on the farm: publications you have made concerning your farm notebook
- Declared plots: the name of your plots, their geolocation, your technical itinerary on this plot, etc.
- Overall information about your farm (Sector, Human resources (no. of labourers), Technical monitoring structure, Useful agricultural area, Size of livestock, Labels)
- Presentation of the farm (farm practices, equipment, animal feed, hedges and trees, water resources)
- Soil and climate conditions
- Your testimonials
By joining a group, you give the group administrators the right to :
- Communicate on Landfiles and outside your membership of this group with the following information: Name of your farm, postcode and town
- Use Landfiles within the group for all the information and data you publish on the group page: photos, comments, test results, answers to questionnaires and surveys issued by the administrator.
- Use your anonymised results, performance and technical itineraries outside the platform.
- Contact you by e-mail for information about your group’s activities
You may withdraw your membership at any time and revoke the administrator’s rights to use your data and publications, as well as authorisation to contact you, by unsubscribing from the group. At any time, the group administrator may choose to exclude you from the group without having to justify this exclusion. In this case, he/she relinquishes his/her rights of access to all your personal information. Landfiles cannot be held responsible for the misuse of personal data by the administrator of a group after unsubscription, but undertakes to transmit on request any information at its disposal necessary to prove such misuse.
- Transfer of data for outsourced processing
We will use specialist service providers to some extent to process your data. These service providers are carefully selected and regularly checked by us. Based on of the agreements signed with the respective data controllers, the latter will only process your personal data in accordance with our instructions and in compliance with our guidelines.
These sub-contractors will therefore be contractually bound to comply with the terms of this Data Confidentiality Policy.

- Scope and modification of this Data Confidentiality Policy
By using the Application and creating a user account, you agree to comply with this Data Confidentiality Policy, as if you had signed a written agreement.
If you do not accept the terms of the Data Confidentiality Policy, you must immediately stop using the Application.
Registration and use of the Application implies that you have read and accept without reservation the entire Data Confidentiality Policy.
This acceptance will be expressed by ticking the box corresponding to the sentence accepting the Data Confidentiality Policy when registering on the Application.
Ticking this box will be deemed to have the same value as a handwritten signature on your part.
We reserve the right to modify the Data Privacy Policy at any time by publishing a new version on the Application, notifying you when you next log on to the Application.
If you do not accept the modified Data Confidentiality Policy, you may exercise your right of refusal by deleting your user account and uninstalling the Application.
The Data Confidentiality Policy applicable is that in force on the date of use of the Application.

In addition to the data confidentiality policy, your registration implies acceptance of the application’s general terms and conditions of use, which can be viewed on the website and in the application settings.
