Terms and Conditions of Use
This document sets out the terms and conditions governing the use of the Landfiles Platform, including the rules of conduct that Users must observe.
The data privacy policy is described on the following page:
1 – Terms and Acceptance
These Terms and Conditions of Use govern the use of the "Landfiles" platform, accessible via the mobile application for iOS and Android compatible devices and via the web application at app.landfiles.com (hereinafter referred to collectively as the "Platform"), made available by Landfiles, a French simplified joint-stock company (SASU) with a share capital of €50,000, registered with the Paris Trade and Companies Register (RCS) under number 830139564, with its registered office at 17 rue Béranger, 75003 Paris, France, represented by Mr Nicolas MINARY acting as President (hereinafter referred to as "we", "us" or "Landfiles").
The term "Platform" refers to the Landfiles mobile application and the web application at app.landfiles.com, together with any associated services accessible through these channels.
In order to access and use this Platform, you must accept these Terms and Conditions (hereinafter the "T&Cs") after having read them, regardless of your country of residence.
Acceptance shall be evidenced by ticking the relevant checkbox during your registration and shall have the same legal effect as a handwritten signature.
We reserve the right to amend the T&Cs at any time by publishing a revised version on the Platform and notifying you by email or by a notification upon your next login.
If you do not accept the amended T&Cs, you must delete your account and cease using the Platform.
The T&Cs applicable to your use of the Platform are those in force at the time of use.
In the event of any translation of the T&Cs into another language, the French version shall prevail.
The T&Cs are supplemented by the Privacy Policy and the Legal Notice, available on the Platform.
Specific terms (hereinafter "Specific Terms"), signed or accepted between a User — or a legal entity on behalf of its members, who shall thereby become Users — and Landfiles, may further specify or derogate from these T&Cs.
Users of the Platform may be referred to as "You" or "User(s)" in the singular or plural.
2 – Services Offered
The Platform provides two complementary services, accessible via the mobile application (iOS and Android) and the web application, and includes a networking service whose main features are described below.
The services provided to you by Landfiles through the Platform are hereinafter referred to as the "Services":
- A free service
- A paid service
The Platform is under continuous development, and the free services may change at the sole discretion of Landfiles (removal, addition, modification). There is no guarantee that the free services listed below will be maintained, as set out in Section 3 "Access to the Platform".
The Services are accessible via the mobile application downloaded and installed on your compatible mobile device, or via the web application at app.landfiles.com from an internet browser.
The Services are strictly reserved for authorised Users who hold a user account (username and password) created by Landfiles. Each user account is unique and strictly personal.
2.1 Creating and Describing an Entity
Any User may create an entity on the Platform. The following fields are mandatory: Name, City, Postcode, Country, Specialisations. Users undertake to enter only accurate data corresponding to a real, existing entity within the list of authorised territories.
2.2 Inviting Users and Access Rights
Any User who holds administrator rights over an entity may invite another User to use the Platform and the Services by granting them one of the following access rights to the entity:
- Administrator: the right to manage Users and modify their rights, to publish, comment on and read all information posted on the entity.
- Publisher: the right to publish photographs and observations on the entity, and to read and comment on existing publications.
- Contributor: the right to comment on publications within the entity.
- Reader: the right to read publications within the entity.
Landfiles is under no obligation to make the Platform available to any User whose usage does not correspond to the intended use cases of the Platform. However, any access request may be submitted to Landfiles by email at: support@landfiles.com.
2.3 Creating and Assigning Publications to an Entity
The term "Publication" refers to photographs and observations published on an entity.
Any User holding "Administrator" or "Publisher" rights may publish photos on the entity, create references (plots, sites, contacts) and assign Publications to those references.
Any data published by a User on an entity may be used by the entity's Administrator. This is authorised, free of charge, for activities related to the entity, worldwide, and for the entire duration of intellectual property protection, and covers the following rights:
- The right to use, in whole or in part.
- The right to view, in whole or in part.
- The right to reproduce, on any existing or future medium, by any means, in whole or in part.
- The right to publish, in whole or in part.
- The right to display, by any means, in whole or in part.
- The right to adapt, modify and translate, in whole or in part.
2.4 Publication Content
Each Publication may include:
- A description.
- Photos.
- Structured data, if a form has been made available by the administrator.
- GPS coordinates.
Once published, members with access to the Publication may add a comment or a "like".
2.5 Entity Visibility and Access Rules
Each entity may be set to public or private mode by its administrator, via the web application.
Public entity (default mode): members of the groups to which the entity belongs may view all content published on the entity (the entity's logbook and publications on groups).
Private entity: only content published on a group is visible to that group's members. Content published on the entity's logbook (outside of groups) is not visible to group members.
In both cases: Users who are not members of any group to which the entity belongs cannot view any of the entity's content.
Only Users with direct access rights to the entity (Administrator, Publisher, Contributor, Reader, as defined in Section 2.2) may access the full content of the entity, regardless of its visibility mode.
2.6 Creating a Group
Any User may create a private group on the Platform. The group name is mandatory. The creator of the group becomes its owner and may invite members by assigning them one of the following roles:
- Owner: the right to manage the group, invite and remove members, modify members' roles, and publish, comment on and read all group content.
- Administrator: the right to invite members, and to publish, comment on and read all group content.
- Guest: the right to publish, comment on and read group content.
Users must be registered on Landfiles before they can join a group. Only invited members may access the group's content.
The administrators of a group may refuse access or remove a user at any time if their registration or usage is inconsistent with the group's purpose. All publications within a group are subject to the same rules as publications on an entity. The rights and responsibilities of users and administrators regarding data management are set out in the Privacy Policy. Creating or joining a group constitutes acceptance of the data usage terms of both Landfiles and the group administrator.
3 – Access to the Platform
3.1 – Access under the Free Service
The Platform is accessible:
- Via the mobile application, available for any device running Android or iOS, as a free download from Google Play and the App Store.
- Via the web application at app.landfiles.com, accessible from any modern internet browser.
You are responsible for the costs of accessing the Platform and the internet, as well as any other charges that may apply in order to connect to or use the Platform.
Downloading the mobile application from an app store requires acceptance of that app store's terms and conditions. It is your responsibility to ensure compliance with the applicable terms and conditions.
Updates to the mobile application will be delivered through the relevant app store. Updates to the web application are deployed automatically by Landfiles.
We will use our best efforts to keep the Platform accessible and available, without assuming any obligation of result.
Access to the Platform may be restricted at any time for maintenance, repair or updates, without prior notice.
We make no commitment as to:
- Any obligation of result in providing the Platform.
- The Platform being free of bugs or continuously available.
- Any frequency of maintenance or updates.
- Any quality of service or continuity of features.
- Any level of service or availability.
- Any duration of support.
We will use our best efforts to operate the Platform in a secure manner. However, we do not guarantee absolute security of the Platform.
We may also suspend, modify or discontinue support for the Platform, including by removing the mobile application from app stores or closing access to the web application.
We are free to modify the Platform at our sole discretion, including by adding or removing features or changing how it operates. The existence of a feature within the Platform shall in no way guarantee its continued availability, which you acknowledge and accept.
In order to use the Platform, you must have a compatible device and browser. Landfiles makes no commitment as to the compatibility of the Platform with your device or browser, nor as to the continued compatibility thereof.
3.2 – Additional Access under the Paid Service
Each client who has subscribed to a paid service agreement benefits from additional guarantees and commitments from Landfiles. These specific commitments are set out in the commercial agreement between the client and Landfiles. In the absence of specific provisions, Landfiles undertakes to provide access to the services specified in the agreement to the best of its ability, and provides the guarantees set out in Section 9.1 of these T&Cs.
4 – Registration and User Account
4.1 Registration
The Platform is accessible to all persons of legal age, who may create a user account.
If a minor wishes to use the Platform and create a user account, they must have obtained written consent from their legal guardian, which must be provided to us upon first request.
By using the Platform, you represent that:
- You have the legal capacity to enter into a binding agreement, either directly or through parental authorisation.
- You are not subject to any prohibition on using the Platform under the laws in force in France or any other country.
The Platform complies with the laws and regulations applicable in France. If you are located in another country, you are responsible for ensuring that your use of the Platform is permitted under local laws and regulations. We provide no guarantee in this regard.
4.2 User Account
You may create only one user account per person.
You are responsible for choosing a sufficiently secure password.
You must also provide the information required to create your user account, in accordance with our Privacy Policy. This information must be accurate, up to date and complete.
This user account will be used to access your session on the Platform.
We shall not be liable in the event of access to your account by a third party, whether by brute force attack or any other unauthorised use of your account, nor for any damage resulting from such use.
You are responsible for the security and use of your account credentials.
In the event of any compromise of your credentials, you must inform us without delay in order to mitigate the risk.
4.3 Account Deletion
If you wish to delete your account, you may do so by contacting support@landfiles.com, or via the relevant option within the Platform, if available.
You must specify whether you wish to delete the contributions you have made. You must also specify whether you wish to delete any entity for which you are the legal representative.
Unless you expressly request otherwise, upon deletion of your account, your contributions will remain available on the Platform and accessible to other Users.
In the absence of an express deletion request, we may choose whether or not to retain any contribution posted by a User or former User, without incurring any liability in this regard.
If you wish to re-register, you may submit a request to support@landfiles.com or request an invitation from another User.
4.4 Account Closure
If we become aware that you lack legal capacity or are in breach of these T&Cs, your account may be closed immediately, without notice and without incurring any liability on the part of Landfiles. Your data may then be deleted immediately, in accordance with our data management policy.

6 – Publishing Content
6.1 User Conduct
6.1.1 Publications and Content
You undertake to ensure that your Publications comply with all applicable laws and regulations.
Publications must not be contrary to public order or good morals, and must not infringe any person's rights.
You are responsible for the Publications you post on the Platform, in any capacity, and for your interactions with other Users.
We have no editorial role over the Publications you post and act solely as a hosting provider, in accordance with French law.
We cannot therefore be held liable for Publications, statements, conduct or exchanges of information by Users.
We reserve sole discretion as to which Publications and content may be posted on the Platform, which you acknowledge and accept.
You may report any Publication or content that may breach these T&Cs by contacting us at: support@landfiles.com.
All Publications are submitted free of charge and you may not request any payment from Landfiles in this regard.
All Publications must respect the rights of third parties, and in particular their intellectual property rights.
The visibility of Publications depends on the entity's visibility mode (public or private) and the group on which they are published, in accordance with the rules set out in Section 2.5.
The following Publications are prohibited on the Platform (non-exhaustive list): illegal content, content liable to criminal sanctions, content contrary to applicable French regulations, content contrary to good morals or public order, content that may offend other Users (including but not limited to pornographic, paedophilic, obscene, hate-inciting, defamatory, discriminatory, hateful, abusive, insulting, aggressive, harassing, violent content, or content relating to the denial of crimes against humanity), content including personal contact details or confidential information, content infringing third-party rights, inaccurate or misleading content, excessively frequent, verbose, superfluous or redundant content, and content or links directing to third-party websites.
6.1.2 Intellectual Property
You undertake to post only Publications over which you hold full intellectual property rights. You also undertake not to reproduce another User's Publication, on the Platform or any other medium, without that User's prior written consent.
You shall indemnify and hold us harmless against any claim or action by a third party arising from an infringement of their rights. This indemnity includes any legal costs and fees we may incur.
Your Publications (text, images and any other elements) remain your property.
You grant us a licence to use your Publications within the Platform and in connection with the Services. This licence is granted free of charge, irrevocably, on a non-exclusive and transferable basis, for the entire duration of copyright protection, and worldwide.
6.1.3 Moderation
In respect of all content published on the Platform, we act as a hosting provider. Our liability cannot therefore be engaged in respect of such content.
In compliance with our legal obligations, we will take the necessary steps to remove any unlawful content upon notification.
We reserve the right to suspend, modify or remove any content at our sole discretion. We may also close the account of any User who fails to comply with these T&Cs, without prior notice.
You may report any problematic content to us at support@landfiles.com.
6.1.4 Security
You undertake not to (non-exhaustive list): compromise the operation of the Platform, attempt to access another User's account, attempt to access our servers outside of normal use, attempt to upload viruses or any other invasive software, extract data or computer code without our prior written authorisation, or use the Platform unlawfully.
6.1.5 Use of the Platform
You may use the Platform in accordance with these T&Cs, to the exclusion of any other right.
You undertake not to reproduce the Platform, reverse-engineer it, adapt, modify, translate, transcribe, arrange, compile, decompile, assemble, disassemble or transcode all or part of the Platform, or attempt to circumvent these T&Cs.
7 – Data
The use of the Platform involves the collection of personal data by us, in compliance with applicable legislation and regulations.
You are fully aware that the personal data you submit directly or indirectly to Landfiles will be subject to automated processing.
The Landfiles Privacy Policy is available on the web application and in the settings of the mobile application.
8 – Technical Support and Contact
We provide technical support at the following address: support@landfiles.com.
This support may be used to report any service anomaly or problematic content, or to ask any question relating to the Platform and its Services. Landfiles will only respond to enquiries corresponding to these matters. Users who have subscribed to a paid service benefit from a dedicated support contact as specified in their agreement.
9 – Warranty
The Platform and the Services are provided free of charge, without any express or implied warranty of fitness for your purposes.
9.1 Warranty for Free-Tier Users
The Platform and the Services are provided on an "as is" basis, without any warranty whatsoever.
You are responsible for ensuring that they meet your needs or expectations, and that you have all the equipment necessary to use them.
We do not warrant the performance or results, whether technical, economic or commercial, of the Platform or the Services. We also do not warrant that the Platform or its content will be free from errors, defects, malware or viruses.
We disclaim all liability for any deterioration, data loss or unavailability of access to the Platform's information, arising from network malfunctions or any other cause beyond our control.
9.2 Additional Warranties for Paid-Tier Users
Upon subscribing to paid services with Landfiles, a specific agreement is signed with the client providing additional warranties. As a general rule, Landfiles undertakes to provide, for the duration of the agreement and to the best of its ability:
- High-availability operation of the Platform,
- Access to the listed services for all users included in the agreement,
- Advance notice of any changes to Platform versions,
- Security of user data,
- In the event of a security incident, notification to the client within 24 hours and implementation of corrective measures,
- Technical support in the event of difficulties,
- A response to any reported issue within 3 business days.
10 – Liability
The Platform is provided on a best-efforts basis.
We will use our best efforts to make it available but shall not be liable for any indirect or consequential damages, including loss of revenue, financial loss or commercial loss arising from or in connection with the use of the Platform and the Services.
We shall not be liable for any physical injury or property damage resulting from access to or use of the Platform or the Services, or from the inability to access or use them.
You are solely responsible for your use of the Platform.
The information provided by Landfiles on the Platform is provided for informational purposes only and without any warranty of accuracy. You must independently verify all information before use; the Platform does not provide advisory services.
Information provided by Users is provided under their own responsibility. Landfiles accepts no liability in this regard.
11 – Intellectual Property Rights
All text, images, domain names, trademarks, designs, models, patents, software and databases used within the Platform are our property or, where applicable, the property of a third party that has granted us a licence of use. These elements are protected worldwide.
We grant you authorisation to download and install the mobile application on your device, to access the web application, and to use the Platform for your professional needs, on a non-exclusive, revocable, free-of-charge, non-transferable and worldwide basis.
You are not authorised to commercialise the Platform or any information obtained from the Platform.
Any partial or total reproduction of these elements may constitute an infringement of intellectual property rights.
12 – Links
The Platform may contain links to third-party websites and content belonging to or originating from third parties.
We do not guarantee the accuracy, relevance or completeness of third-party websites and are not responsible for their content. Access to third-party websites from the Platform is at your own risk.
13 – Miscellaneous Provisions
13.1 Compliance with Legislation
The Platform complies with French regulations. Landfiles shall not be held liable if a User located outside France uses the Platform in breach of applicable foreign regulations.
13.2 Entire Agreement
These T&Cs shall prevail over any other terms. They are supplemented by the Privacy Policy and the Legal Notice. These T&Cs supersede and replace all prior commitments relating to their subject matter.
13.3 Non-Exclusivity
No exclusivity is created between the Parties by acceptance of these T&Cs.
13.4 Survival
The termination of these T&Cs, for any reason whatsoever, shall not affect the validity of any clause whose nature or content requires its continuation.
13.5 Severability
If any one or more provisions of these T&Cs are held to be invalid, the remaining provisions shall continue in full force and effect.
13.6 Non-Waiver and Tolerance
Failure by Landfiles to enforce any provision shall not be construed as a waiver of the relevant obligation.
13.7 Independence
Neither Party may make any commitment on behalf of the other.
13.8 Evidence
The Parties agree that all electronic communications, including emails, shall constitute admissible evidence between them.
13.9 Force Majeure
In the event of Force Majeure, Landfiles will use its best efforts to maintain the operation of the Platform. If the Force Majeure event persists, Landfiles may discontinue the Platform's services without notice and without incurring any liability.
13.10 Governing Law and Jurisdiction
These T&Cs are governed by French law.
Any dispute arising out of or in connection with these T&Cs that cannot be resolved amicably between the Parties shall be submitted to the competent court within the jurisdiction of the Paris Court of Appeal.
