Data Privacy Policy
This document sets out the Data Privacy Policy applied by Landfiles.
In summary, Landfiles protects your data and limits its use to the proper functioning of the Application, with a view to providing services to Users.
You remain the owner of your data. Any supplementary service (for example, a scientific study) requiring specific data processing shall give rise to an explicit consent request addressed to each user via their user account. By default, and in the absence of any action by the user, data shall not be used for such supplementary services.

Terms and Conditions of Use
This application (hereinafter referred to as the "Application") is made available by Landfiles, a simplified joint-stock company with sole shareholder (SASU) with share capital of €50,000, registered with the Paris Trade and Companies Register (RCS) under number 830 139 564, whose registered office is located at 17 rue Béranger, 75003 Paris, France, represented by Mr Nicolas MINARY acting in his capacity as President (hereinafter referred to as "we", "us" or "Landfiles").
The confidentiality of your Personal Data is of paramount importance to Landfiles, which has implemented strict rules and procedures to protect it. You should read this Data Privacy Policy carefully.
You are hereby informed that the personal data submitted and collected shall be subject to automated processing, as described below.
This Data Privacy Policy may be derogated from upon registration of an entity to a group on the Application. In all cases, you shall be informed of any such derogation upon registration of an entity to a group, within the legal notices pertaining to that group, and such derogation shall be subject to your prior acceptance. You may notify us at any time of your refusal of such derogating provisions via the contact procedure set out in this document. We shall not derogate from this Data Privacy Policy without your specific agreement.
1. Personal data
1.1 Collection and processing of personal data
In order to provide the Application, we are required to collect personal data necessary for its functionalities.
This Data Privacy Policy informs you of the manner in which Landfiles collects and processes your personal data when you use the Application.
Use of the Application requires the collection of the following data, which must be provided when creating your user account:
- Surname*, first name*
- Email address*
- Telephone number
- Password*
- Your profession*
- Your working group (CETA, GIEE, etc.) or affiliated organisation (your employer, your company, your educational institution, etc.)

This personal data may also be updated via your user account throughout your use of the Application, once the relevant functionality is made available. In the meantime, you may contact Landfiles to amend this data at the following address: support@landfiles.com
When you use our Application, the following data may be transmitted to us by the Application in order to enable its operation or optimisation:
- Your GPS coordinates when taking a photograph
- The date and time of access
Your surname, first name and profession shall be disclosed to other users of the groups to which you are subscribed, in order to facilitate the sharing of information within those groups. You consent to this disclosure.
No other information shall be provided to any third party without your consent, save for our sub-processors and in accordance with this Data Privacy Policy.
Personal data collected is stored in France by our hosting provider Blakane, on servers located in France. Photographs are hosted by Google Cloud within the European Union.
Personal data shall be retained for the duration of the user account activity, without time limitation for clients holding an active subscription. In the event of termination of the subscription, data shall be retained for a period of two (2) years from the date of termination. Upon deletion of your user account, for whatever reason, we shall delete all your personal data, with the exception of data strictly necessary for the maintenance of our commercial accounting records and compliance with our legal obligations.
1.2 Your rights
In accordance with the French Data Protection Act (Loi Informatique et Libertés) and the General Data Protection Regulation (GDPR), you have the following rights in respect of all personal data transmitted to Landfiles:
- Right of access to, and information about, the personal data we hold concerning you;
- Right to request the rectification, erasure or restriction of processing of your personal data;
- Right to object to processing carried out on grounds of legitimate interest, public interest or profiling, unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing is for the establishment, exercise or defence of legal claims;
- Right to data portability;
- Right to lodge a complaint with a data protection supervisory authority;
- Right to withdraw your consent to the collection, processing and future use of your personal data.
To exercise any of these rights, please send your request to the email address indicated below.
In accordance with its legal obligations, Landfiles shall comply within a maximum period of one (1) month from receipt of the request.
2. Other data not constituting personal data
2.1 Identifiable data
In the course of using the Application, other data (photographs and descriptions, comments and tags, lists of plots and livestock, information relating to the entity) that does not constitute personal data shall be transmitted to Landfiles.
Subject to your consent within the Application, we may access the following:

Your other identifiable data is used for the implementation of search and user-matching functionalities within the Application.
You are responsible for the content and accuracy of such data and information, and for compliance with third-party rights in respect of such data.
Public identifiable data: the person who publishes data retains ownership thereof, shared with the legal representative of the entity, who may accordingly use public data published by another user at their discretion.
2.2 Anonymised data
Your other data, once anonymised, is used for the implementation of internal Application functionalities, in particular search and user-matching features.
Landfiles does not make any other use of anonymised data without the user's consent. Anonymised data (whether public or private) may be used for the creation of algorithms, statistical analyses and the conduct of studies, the purpose of which shall be set out in your user account, from which you may give your consent to such use. If you consent, such anonymised data shall be used by Landfiles free of charge and without time limitation. By default, your anonymised data is not used for such purposes.
The anonymisation process is as follows:
- The author of the published data is removed.
- The name of the entity associated with the publication is removed, together with any national identifiers.
- The location of the entity is removed (except for the département).
We may cross-reference data from the same entity prior to anonymisation, in particular:
- Links between photographs, tags, comments and observations, prior to application of the anonymisation procedure. The link between elements thereby becomes a technical link rather than a link by author or entity.
- Links between a plot, an animal or a group of animals, provided that the name of the plot, animal or group of animals is replaced by a technical identifier that does not permit tracing back to the source data.
- Département of the entity.
- Activities of the entity.
3. Data sharing in connection with group participation
3.1 Creation and administration of a group on Landfiles
You may at any time create a working group on Landfiles, of which you shall automatically become the administrator. You may invite other persons to join your group by sending an invitation by email, by sharing the group link with your contacts, or by sending an invitation directly through the Application. To become a member, the user must create a Landfiles account and accept both the Terms and Conditions of Use and this Data Privacy Policy. As administrator, you are responsible for ensuring compliance with these terms within your group. Any member who joins the group shall have access to all information and publications within the group, including its history. Should you wish to establish additional rules of conduct for the group, you may set these out in the group description.
You may exclude from the group any person who fails to comply with the rules of Landfiles or with your own rules, and any user may at any time choose to unsubscribe from the group.
Departure from the group, for whatever reason, shall prohibit you from accessing the user's personal data, and you undertake not to use any information obtained about the user through the Landfiles application. Landfiles reserves the right to take any legal action in the event of non-compliance with the user's rights by the administrator following unsubscription from the group, including referral to the CNIL (French Data Protection Authority).
3.2 Management of personal data within a group
Joining a group on Landfiles may occur through two means:
- By invitation from a group member or the administrator
- By the user's own request to join the group
Participation in a group enables you to view comments, photographs, publications and measurements shared by other users within the group. It also enables you to react to such publications by means of likes, comments, or shares within or outside the group. You may yourself publish within these groups under the same conditions, as a member.
By joining a group, you automatically grant the administrator and group members read access to the following personal information:
- Your surname and first name, email address
- The name of your entity
- The postcode and town of your entity
- Its geolocation, if provided
- All information entered on your entity profile:
- Entity observations: publications you have made in your entity logbook
- Declared plots: the names of your plots, their geolocation, your technical itinerary for each plot
- General information relating to your entity (sector, human resources (FTE count), technical support structure, utilised agricultural area, herd size, certifications)
- Entity profile (practices on the holding, equipment, animal feed, hedgerows and trees, water resources)
- Pedoclimatic context
- Your testimonials
By joining a group, you grant the group administrators a delegation of rights to:
- Communicate on Landfiles and externally your status as a member of that group, together with the following information: name of your entity, postcode and town
- Use within the group on Landfiles all information and data you publish on the group page: photographs, comments, trial results, responses to questionnaires and surveys issued by the administrator
- Use outside the platform your results, performance data and technical itineraries in anonymised form
- Contact you by email for information relating to the activity of your group
You may at any time withdraw your consent and revoke the administrator's rights to use your data and publications, as well as the authorisation to contact you, by unsubscribing from the group. At any time, the group administrator may choose to exclude you without being required to justify such exclusion. In doing so, the administrator relinquishes all rights of access to your personal information. Landfiles shall not be held liable for any misuse of personal data by a group administrator following unsubscription, but undertakes to provide, upon request, any evidence in its possession necessary to establish proof of such misuse.
4. Data transfers for sub-processed operations
For the processing of your data, we may to a certain extent engage specialised service providers. Such service providers are carefully selected and regularly monitored by us. On the basis of data processing agreements entered into with the respective service providers, they shall process your personal data solely in accordance with our instructions and directives.
Such sub-processors shall be contractually bound to comply with the terms of this Data Privacy Policy.
Where processing involves the use of external tools (in particular in connection with artificial intelligence or automation services), these shall be detailed in the statement of work presented by Landfiles to its client. No processing by artificial intelligence shall be carried out outside of specific engagements that are the subject of a separate statement of work.

5.1 Cookies and trackers
The Application does not use any advertising cookies or trackers. Session cookies may be used for the technical operation of the Application.
6. Scope and amendment of this Data Privacy Policy
By using the Application and creating a user account, you agree to comply with this Data Privacy Policy as though you had signed a written agreement.
If you do not accept the terms of this Data Privacy Policy, you must immediately cease using the Application.
Registration for and use of the Application presupposes that you have read and unreservedly accepted this Data Privacy Policy in its entirety.
Such acceptance shall be expressed by ticking the box corresponding to the acceptance statement of the Data Privacy Policy upon registration on the Application.
Ticking this box shall be deemed to have the same legal effect as a handwritten signature.
We reserve the right to amend this Data Privacy Policy at any time by publishing an updated version on the Application, and notifying you upon your next login to the Application.
In the event that you do not accept the amended Data Privacy Policy, you may exercise your right of refusal by deleting your user account and uninstalling the Application.
The Data Privacy Policy applicable at any given time shall be the version in force at the date of use of the Application.
7. Terms and Conditions of Use
In addition to this Data Privacy Policy, your registration constitutes acceptance of the Terms and Conditions of Use of the Application, which are available on the website and within the Application settings.
